Definitions

There are a number of terms used throughout this website that you may be unfamiliar with. This list will assist you with the meanings of those terms.

Guild Insurance works closely with professional associations to develop targeted risk management guidance and solutions for their members.

We look to create an awareness of risks for businesses and professionals, improving risk management practices and minimising claims and complaints. This helps us to protect the reputation of the profession and to maintain stability with insurance premiums.

In a number of allied health professions, Guild works with association peak bodies to convene regular Risk Management Committee meetings. The Risk Management Committee examines claims and complaints made, to identify risk exposures and communicate these risks to the profession.

The Committees are generally comprised of practitioners with expertise in various fields of practice, association representatives, and Guild’s risk management specialists, underwriting and lawyers.

The Committees contribute to the development of a number of materials to raise awareness of risk management, such as presentations, articles, publications, and Riskequip, the online risk management resource.

Inquiries and Proceedings cover covers you for legal costs and expenses associated with a disciplinary or coronial investigation, hearing or inquiry.

This cover gives you access to legal representation and assistance for board inquiries and other disciplinary matters. You also receive support preparing a response to a complaint or for an informal hearing.

While every effort can be made to determine your ‘sums insured’ and set “limits” correctly, rising building costs and other factors often cause the value of your building and contents to increase. Limiting your insurance cover to a set figure leaves you at risk of underinsurance.

Guild Insurance is the one of the few insurers providing full Replacement Cost cover, which means we fully replace your building and contents.

Additionally, other insurance policies often contain ‘underinsurance’ or average’ provisions, which mean that even for partial damage to your business, the insurer can assess the total value of your business and if they find that you are underinsured, they can reduce your final payout. Guild on the other hand will always pay you out to the replacement cost of the damages.

In the course of your professional practice, you may have to make decisions on whether or not to report incidents that lead to a potential claim. If you are even considering “should I report this incident?”, then we recommend a strategy of ‘better to report than not’.

There’s no harm done when you notify Guild of an incident. You will not incur penalties but rather give yourself the best chance to obtain the best outcome for all parties. Reporting an incident merely means that we have a record, in the case that a claim might eventuate.

Reporting incidents:
•    allows effective investigation to take place to help to avert a more serious claim, or defend a claim if received, and
•    is also a requirement under your insurance policy for those incidents that the insured feels may give rise to a claim.

Another important reason to report incidents immediately is that Guild Insurance offers direct access to a legal firm whose experience in these matters positions them ideally to provide advice on how to deal with potential claims.

Imagine if you were forced to close your business for a week, a month, or even a year due to damage. What impact would that have? How would you cover costs such as staff payments and lost business income while you were unable to trade?

This is where sufficient Business Interruption cover is vital in providing you with cover for ongoing business expenses, increased cost of working and loss of income due to disruptions to your pharmacy caused by insured damage.

If you are underinsured for Business Interruption cover you could be left to pay ongoing out-of-pocket expenses for disruptions to your business, which can quickly add up.

Working in the public sector you need to decide whether or not to take out your own liabilities insurance.

One good reason for taking out your own cover is that litigation can potentially be directed against both employee and employer, either separately or jointly. In such cases an employee may not be sufficiently protected against the liability exposure of a negligence claim without their own liabilities insurance. The costs can be significant whether or not they are found liable.

In the event of a claim arising from an incident involving treatment of a patient, the employer and the employee can often have differing interests. With your own cover you can be sure that your own interests are defended.

Guild can cover you for claims arising in all of the places where you work, and also provides cover outside of the hospital environment. This may include working in private practice on weekends or assisting at sporting events.

In most cases Guild provides a combined liabilities cover to offer peace of mind. For the insured, products liability, public liability and professional indemnity are all covered under the one policy.

Some insurance policies provide cover limited to a pre-determined value, the ‘sums insured’ or ‘limit of liability’, for building and contents.

In the case of Professional Indemnity, Home & Contents and Car Insurance, these sums insured are selected upon application (refer to insurance Features & Benefits for details), but in the case of Business Insurance a Guild Customer Service Executive can help you to assess your level of cover.

While every effort can be made to determine your ‘sums insured’ and set ‘limits’ correctly, rising building costs and other factors often cause the value of your business to increase. Limiting your insurance cover to a set figure can therefore leave you at risk of underinsurance.

It is our experience that underinsurance is often an issue in major incidents and can expose businesses and homes to out-of-pocket expenses for hundreds of thousands of dollars.

Guild Insurance offers full replacement cost for some of its business insurance products, which provides protection against underinsurance. We also provide a 20% safety net to guard against underinsurance in our Home & Contents Insurance. 

For some of the Liabilities schemes, you will have a common renewal date. A common renewal date enables Guild Insurance to have an independent actuarial review conducted on an annual basis, to ensure that our premiums are in line with claims figures. When your insurance policy is due for renewal we’ll be in contact with you in the weeks prior. If you haven’t heard from us and you think you should have, give us a call.

Most of our liabilities insurance policies work on a claims made basis meaning that cover is provided according to the date a claim is made rather than when the incident occurred.

Along with our retroactive cover, this means that you have current cover for claims resulting from past practice, which you aren’t yet aware of. An important aspect of a claims made insurance policy is that incidents must be reported once they become known.

1. Information on how to enter and the prize forms part of these conditions of entry. Entry into this competition is deemed to be acceptance of these Terms & Conditions.

2. PROMOTIONAL PERIOD: The competition commences 15 November 2011 at 9:00am (AEST) and concludes 15 April 2012 at 10.00pm (AEST).

3. HOW TO ENTER: 

  • Take out a Professional Indemnity Policy for Fitness Professionals or a Business Insurance Policy for Fitness Professionals with Guild Insurance (“Guild Insurance Policy”) during the Promotional Period; Entrants receive 1 entry for each policy purchased within the promotional draw period. Entrants must be a member of Fitness Australia or a Registered Exercise Professional with Fitness Australia to be eligible for the draw.
  • Policies must be purchased and paid in full by no later than 10:00pm (AEDST) on 15 April 2011. Entries will be deemed to be accepted at the time of the payment of the policy. No responsibility will be accepted for late, lost, incomplete or misdirected entries.
  • The Guild Insurance policy must be valid at the time of the prize allocation in order to receive the Prize. If the Guild Insurance policy is not active at the time of the prize allocation or is cancelled prior to the prize allocation for any reason, it will not be a valid entry.

6. The Promoter’s decision in relation to any aspects of the competition is final and binding on every person who enters and no correspondence will be entered into.

7. By entering into the prize draw, entrants will be deemed to have read and agreed to abide by these conditions.

10. In the event of unclaimed prizes a redraw will be conducted 3 months after the date of the final original draw. The redraw will occur on 16 July 2012 at 9am and take place at the Registered Office of Guild Insurance, 5 Burwood Road Hawthorn, Victoria. The redrawn winner will be notified in writing, and the results will be published on the Guild Insurance website at www.guildinsurance.com.au.

11. The prize must be taken as offered and cannot be varied unless authorised by the Promoter. The prize value includes GST and is in Australian dollars and is correct at time of printing. The Promoter accepts no responsibility for any variation in prize value. If a prize or part of is unavailable, for whatever reason, the Promoter reserves the right to substitute the prize for a prize of equal or greater value subject to any written directions from the various lottery departments.

 12. The Promoter reserves the right to reasonably amend or vary these Terms and Conditions at its sole discretion, without prior notice subject to written directions from a State Regulatory bodies

13. The Promoter accepts no responsibility for any tax implications that may arise from acceptance of the Prize winnings. Independent financial advice should be sought prior to entering the competition and acceptance of the Prize.

14. The Promoter collects personal information about you in order to enable you to participate in this promotion. Use of such personal information will be used in accordance with these Terms and Conditions.

 15. The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.

16.  The Promoter’s responsibility for the provision of any Prize is limited to the Prize described in these Terms and Conditions. 4. THE PRIZE:

a. There will be one (1) Winner of the competition and one (1) prize. The Winner will receive a standard factory model Holden Barina Spark 5 Door Manual 1.2Lt valued at $14,999 and delivered by Penfold Holden, Burwood 142 Burwood Highway, Burwood Vic., 3125. 

b. Any optional extras including operational and maintenance costs will be at the Winner’s expense. The colour of the prize will be at the Promoter’s discretion.

c. Risk in the prize transfers to the Winner upon the Promoter declaring the person a Winner. The winner must agree to release Guild Insurance from any liability for any loss or damage suffered in connection with the prize.

d. The prize Winner must hold or be eligible to apply for an Australian Drivers Licence in order to accept the prize. The recommended retail value of the Prize in Victoria is $14, 999 inclusive of GST and includes on road costs.

e. A comprehensive car insurance policy will also be supplied for the vehicle. Both the registration for the vehicle and the insurance policy will be issued under the name of the winner. Value of the insurance policy is valued up to $750. (exact value will be dependant on the information provided by the winner to write the policy)

f. The winner will be chosen via a random prize draw. The draw will take place on Monday 5 December 2011 at 4:30pm (AEDST) at the Registered Office of Guild Insurance, 5 Burwood Road, Hawthorn Vic 3122.  The Winner will be notified by phone and in writing. The Winner’s name will be published on the Guild Insurance website at www.guildinsurance.com.au and will also be published in the Australian Newspaper on Monday 12 December.

8.  The prize must be taken as stated and no compensation will be payable if the winner is unable to use the prize as stated. The prize is not transferable to another person or exchangeable. By entering this promotion unless otherwise advised, each entrant also agrees that the Promoter may use the entrants name, likeness, image and/or voice (including any photograph, film and/or recording of the same) in any media for an unlimited period of time without remuneration for any purpose whatsoever. Entrants’ personal information may be disclosed to State and Territory lottery departments and winners’ names published as required under the relevant lottery legislation. 16.  The entrant agrees to participate and co-operate with the Promoter as required in all editorial and promotional activities relating to the competition, including but not limited to being interviewed and photographed for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter for an unlimited period of time without remuneration. The Winner also agrees to grant to the Promoter a perpetual and exclusive license to use such footage and photographs in all media worldwide and the Winner will not be entitled to any fee for such use.

17.  The Promoter is not responsible for any incorrect or incomplete information communicated to any party including through advertisements in the course of or in connection with this competition.

18.  If for any reason this competition is not capable of running as planned, including but not limited to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures, malfunction of any telephone network or line, providers or any other causes beyond the control of the Promoter, which corrupts or affects the administration security, fairness or integrity or proper conduct of this competition. The Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process.
